1. Acceptance of Terms
By accessing and using Tresal's services, including our website, platform, and any related applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use our Service.
These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using any part of the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
Tresal provides an attack surface management platform that helps organizations discover, monitor, and manage their digital attack surface. Our Service includes vulnerability scanning, continuous monitoring, asset discovery, and risk assessment capabilities.
We may, at our sole discretion, modify or discontinue the Service or any features, capabilities, or functionality of the Service at any time, temporarily or permanently, without notice to you. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Subscription Terms
Tresal offers various subscription plans with different features, limitations, and pricing. By subscribing to our Service, you agree to pay the applicable subscription fees as described on our pricing page or as agreed upon in a separate agreement.
Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen billing cycle. Unless otherwise stated, subscriptions automatically renew at the end of each billing cycle unless cancelled by you before the renewal date.
We reserve the right to change our subscription fees upon reasonable notice. Such notice may be provided by email or by posting the changes on our website. Your continued use of the Service after such notification constitutes your acceptance of the new fees.
5. Service Level Agreement
Tresal will use commercially reasonable efforts to make our Service available with a Monthly Uptime Percentage of at least 99.9% during any monthly billing cycle ("Service Commitment").
In the event we do not meet the Service Commitment, you will be eligible to receive a service credit as described in our Service Level Agreement (SLA). The SLA provides our sole liability, and your exclusive remedy, for any failure by us to meet the Service Commitment.
The SLA does not apply to any unavailability, suspension, or termination of the Service, or any other performance issues that are: (i) caused by factors outside of our reasonable control, including force majeure events; (ii) result from your equipment or third-party equipment or software; or (iii) result from actions or inactions by you or any third party.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable national, federal, state, local, or international law or regulation.
- To scan or test security vulnerabilities of any systems, networks, or assets for which you do not have explicit authorization.
- To transmit or distribute malware, viruses, or any other malicious code.
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
- To attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
- To perform any actions that could reasonably be expected to negatively impact the stability or availability of the Service.
7. API Usage
If you use our API as part of the Service, you agree to comply with our API Terms of Use. Our APIs may have rate limits, and you agree not to exceed those limits or to attempt to circumvent them.
We may monitor your use of the API to ensure compliance with these Terms, to maintain the security and integrity of our Service, and to analyze API usage patterns to improve our Service.
We reserve the right to modify, suspend, or discontinue any API at any time, with or without notice. We will not be liable for any harm or damages resulting from API changes, failures, or discontinuation.
8. Data Handling and Privacy
Our Privacy Policy describes how we collect, use, transfer, and store your information when you use our Service. By using our Service, you agree to our data practices as described in the Privacy Policy.
We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect your information. However, no security system is impenetrable, and we cannot guarantee the absolute security of your data.
If you are using our Service to process personal data subject to data protection regulations (such as the GDPR), you remain the data controller for such personal data, and we act as a data processor. In such cases, our Data Processing Agreement (DPA) will apply.
9. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Tresal and its licensors. The Service is protected by copyright, trademark, and other laws of both the country in which you are accessing our Service and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Tresal.
We respect the intellectual property rights of others. If you believe that material available on our Service infringes upon your copyright, please contact us.
10. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Tresal does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
The results provided by our security scanning and monitoring features are based on automated tools and industry best practices but may not identify all security vulnerabilities or risks. You acknowledge that security testing is inherently limited and cannot guarantee the absence of security issues.
11. Limitation of Liability
In no event shall Tresal, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.
12. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or cancel your subscription through your account settings.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the European Union and its member states, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes to the Terms by posting the updated Terms on our website and updating the "last updated" date at the top of these Terms.
Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new terms, please stop using the Service.
